Premium Retailer Cash Grab 2018 Promotion

As a PPS Premium Retailer, you can participate in our fantastic new PPS promotion -  where you could have a chance to win up to $250,000 in cash. 

The Details:

Promotion Period:   7 April – 29 June 2018

During this period (provided you qualify with 80% recharge rate), every eligible Optus Prepaid product that you have sold that activates will automatically get you an entry into the major prize draw (on 11 July 18), for the chance to participate in a game of chance (‘The Game’) for the opportunity to win up to $250,000.

‘The Game’ takes place:  27 July 2018, at Optus in Macquarie Park, Sydney, NSW.  (If the winning participant lives outside of NSW, we’ll fly them here for the day).

Prize:    The winner selects one from 100 Optus SIM envelopes to determine their prize.  Each envelope contains one of the following prizes:

$250,000 cash (1 envelope), or

$10,000 cash (3 envelopes), or  

$5,000 cash (96 envelopes).

How does it work?

  • Just keep selling eligible Optus Prepaid products.  Every eligible product that you’ve sold, as a qualifying Premium Retailer, that activates during this promotional period will give you an entry in the draw.
  • For an Eligible Retailer to qualify to be entered into the draw, 80% of SIMs activated for their store during the promotional period must also be recharged during the Promotional Period (e.g. for a value SIM, this recharge is automatic on activation; for a $2 SIM, the SIM must also be recharged with additional value).
  • Eligible Optus products include Optus Prepaid SIMs and handsets, and Optus Prepaid mobile broadband SIMs and devices.   Optus Recharges are not counted for this promotion.
  • Eligible activations are those activated by customers between 7 April and 29 June 2018  - the promotional period. Eligible Optus product(s) must be activated in the name of the end user only (i.e. the purchaser).
  • The winner of the draw will get to participate in the Cash Grab ‘Game’, selecting  just 1 out of  100  Optus SIM envelopes. One of these will envelopes will contain the major prize of $250,000 in cash.   Three will have $10,000 in cash, and the remaining 96 will have $5,000.

Eligible Retailers:

Entry is only open to Optus Prepaid Services Premium Retailers within Australia that have a Retail Agreement with the Promoter and have been invited to participate in this Promotion.

How to Enter:

  1. Subject to (II) below, Eligible Retailers will receive one (1) automatic entry into the draw each time one (1) of the following actions is undertaken during the Promotional Period:
  1. a $2, $10 or $30 Optus Prepaid SIM that was sold by the Eligible Retailer is activated in the name of the end user;
  2. an Optus Prepaid Handset that was sold by the Eligible Retailer is activated; and/or
  3. an Optus Prepaid Mobile broadband device that was sold by the Eligible Retailer is activated.
  1. For an Eligible Retailer to be entered into the draw, 80% of SIMs activated for their store during the Promotional Period must also be recharged during the Promotional Period (e.g. for a value SIM, this recharge is automatic on activation, for a $2 SIM, the SIM must also be recharged with additional value).

 

All products must be activated or recharged (as applicable) by the purchaser prior to the close/date time of the Promotional Period in order for the Eligible Retailer to receive an entry in respect to that activation/recharge. Entries will be awarded according to the date of activation/recharge regardless of time delay associated with accessing the activation/recharge data.

 

Optus Prepaid SIMs MUST be activated in the name of the end user only (i.e. the purchaser). Any Eligible Retailer who pre-activates an Optus Prepaid SIM in breach of this condition will be disqualified from the promotion and all their entries will be removed and disqualified.

Entries permitted:

Entrants may enter multiple times provided each entry is submitted separately in accordance with the entry instructions above. By completing the entry method, the entrant will receive one (1) entry.

Total Prize Pool:

Up to AUD $251,312.00

Draw Date/Time:

11/07/18 at 02:30pm AEST

Winner notification:

The winning Eligible Retailers will be notified by telephone and email within two (2) business days of the draw. The Cash Grab Draw winner will be published in The Australian newspaper on 20/07/18.

To whom prize awarded:

The prize will be awarded to the owner of the respective winning Eligible Retailer who may, in his/her absolute discretion, allocate the prize to any employee of that store who is an Australian resident aged 18 years or over.

Unclaimed Prizes:

Prize must be claimed by 11/10/18 at 02:30 pm AEDT. In the event of an unclaimed prize, the prize will be redrawn on 12/10/18 at 02:30 pm AEDT at Plexus, Level 2, 35 Little Bourke Street, Melbourne VIC 3000 Australia. The winner of the redraw will be notified by telephone and email within two (2) business days of the redraw. The winner will be notified publicly (and their details published) in The Australian on 19/10/18.

 

  1. Participants agree and acknowledge that they have read these Conditions of Entry (and Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.
  2. The Promotion commences on the Start Date and ends on the End Date ("Promotional Period"). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
  3. Valid and eligible entries will be accepted during the Promotional Period.
  4. Employees (and the immediate family members) of agencies/companies directly associated with the conduct of this Promotion, the Promoter, its distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. If a prize is won by a person under the age of 18, the prize may be awarded to the winner's parent or guardian and where applicable to the prize a nominated parent/guardian must accompany any person under 18 years of age.
  6. Cash Grab Draw & Game Details:
    1. All entries received during the Promotional Period will be entered into the Cash Grab Draw.
    2. The Cash Grab Draw will take place on 11/07/18 at 02:30pm AEST at Plexus, Level 2, 35 Little Bourke St, Melbourne VIC 3000.
    3. The draw conductor may draw additional reserve entries in case an invalid entry or entrant is drawn.
    4. The Promoter will ensure each draw is open for public scrutiny and anyone may witness the draw on request. The winner of a drawn prize is determined by chance.
    5. The first valid entry drawn will win the prize taker (“Participant”) the opportunity to play a contingency game (“the Game”) for the chance to win $250,000.
    6. The Game will take place at Optus, 1 Lyonpark Road, Macquarie Park, NSW 2113 on 27/07/18 at 3:00pm AEDT. In order to participate in the Game, if the Participant resides outside of NSW, he/she will receive one return economy airfare from his/her nearest capital city in Australia to Sydney, NSW on the day of the Game, valued at up to $1,312 depending on point of departure. If the drawn Participant resides within NSW, the Participant will be responsible for his/her own transport to and from the Game. Spending money, meals, taxes (excluding airline and airport taxes), any accommodation, insurance, transport to and from departure point, transfers, items of a personal nature (including but not limited to in-room charges) and all other ancillary costs are not included. If the Participant cannot attend the Game, the Participant may appoint a proxy over 18 years of age to play the Game on his/her behalf provided the Participant gives the Promoter written, signed notice to that effect before the start of the Game.  If the Promoter has not been able to contact the Participant before the start of the Game, a representative of the Promoter will play the Game on the Participant’s behalf.
    7. There will be one hundred (100) numbered Optus SIM packs on display at the start of the Game. One (1) Optus SIM pack will contain a promotional message representing $250,000; three (3) Optus SIM packs will each contain a promotional message representing $10,000; and ninety-six (96) SIM packs will each contain a promotional message representing $5,000. The Participant/proxy/representative (“Attendee”) must choose only one (1) Optus SIM pack without touching, handling or interfering in any way with any of the other Optus SIM pack on display.  If the Attendee is found to have breached this condition, he/she will be disqualified. If the Attendee selects the Optus SIM pack containing the promotional message representing $250,000 then, subject to verification by the judges, the drawn Participant will win $250,000 (and the $5,000 and $10,000 prize will not be awarded).  If the Attendee selects an Optus SIM pack containing a promotional message representing $10,000, then the $5,000 prize and $250,000 prize will not be given away and, subject to verification by the judges, the drawn Participant will win $5,000. If the Attendee selects an Optus SIM pack containing a promotional message representing $5,000, then the $250,000 prize and $10,000 prize will not be given away and, subject to verification by the judges, the drawn Participant will win $5,000. The prize will be awarded in the form of a cheque made payable in the winner’s name.
    8. The drawn Participant’s odds of winning the $250,000 prize are 1 in 100. The odds of being drawn as a Participant may be significantly higher than the odds of the drawn Participant winning the $250,000 prize, and will depend upon the number of entries received.
  7. The Promoter reserves the right, at any time, to verify the validity of Eligible Retailers (including their sales records) and reserves the right, in its sole discretion, to disqualify any Eligible Retailer who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  8. All reasonable attempts will be made to contact each winner.
  9. If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize by the time specified by the Promoter, or is unavailable, they forfeit the prize and the Promoter is not obliged to substitute the prize.
  10. The value of the prizes is accurate and based upon the recommended retail value of the prizes (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prizes after that date.
  11. If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and/or specification, subject to any written directions of a regulatory authority.
  12. No entry fee is charged by the Promoter to enter the Promotion.
  13. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
  14. Entrants' personal information will be collected by the Promoter. Personal information will be stored on the Promoter's database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at http://www.optus.com.au/about/legal/privacy. The Promoter's privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. Personal information collected from entrants will not be disclosed to any entity located outside of Australia.
  15. It is a condition of accepting the prize that a winner (or their parent or legal guardian if under the age of 18) may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize. If a winner is under the age of 18, a nominated parent or legal guardian of the winner will be required to sign the legal release on the winner's behalf.
  16. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.
  17. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  18. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
  19. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
  20. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
  21. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  22. The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.
  23. Unless otherwise specified, a prize is a single event for the winner (and where relevant their guests) and cannot be separated into separate events or components.
  24. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
  25. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
